ORDER

This Criminal Miscellaneous Petition has been filed to cancel the interim Suspension order granted to the respondent herein /A3 by this Court vide order dated 15.06.2023 in Crl.M.P.No.7532 of 2023 in Crl.A.No.607 of 2023.

2. Totally, there are five accused in C.C.No.37 of 2013 on the file of the Special Court under TNPID Act, Coimbatore and the respondent herein is one of the accused/A3. The learned Special Judge, vide judgment dated 16.11.2022 passed in C.C.No.37 of 2013 convicted and sentenced the accused persons. Aggrieved by the same, the accused A1 to A3 had filed Criminal Appeal in Crl.A.No.607 of 2023 along with Crl.M.P.No.7532 of 2023 before this Court. This Court vide order dated 15.06.2023 in Crl.M.P.No.7532 of 2023 granted interim suspension of sentence with certain conditions. 2/5

This Court while granting interim suspension of sentence, directed the respondent herein to pay 20% of the fine amount imposed on the respondent within a period of two months from the date of release. It is submitted by the learned Additional Public Prosecutor appearing for the petitioner that the respondent herein/A3 has not complied with the abovesaid conditional order of this Court. Hence, the petitioner/Police has filed this criminal miscellaneous petition seeking to cancel the interim Suspension order granted to the Respondent. Since the respondent herein/A3 has not complied with the conditional order of this Court dated 15.06.2023, interim suspension of sentence granted to the respondent is hereby cancelled. The petitioner/Police is directed to take steps to secure the respondent/A3.

4. With the abovesaid direction, this Criminal Miscellaneous Petition is allowed.
