This application has been filed by the defendants in the suit seeking to set aside the exparte order dated 21.12.2016.

2. In the affidavit filed in support of the said application it had been stated that the learned counsel for the plaintiff had served notice along with the summons on their counsel as directed by the First Assitant Registrar. But, however, Vakalath was not filed and owing to fact, the applicants had been set exparte. The Original Side Rules provides that service of suit summons under Order IV Rule 7(3) when counsel had entered appearance in the Interlocutory Applications.

3. In view of the reasons stated, this application is allowed. No order as to costs.
