O R D E R

As against the order passed in W.P.No.13025 of 2007 as stated earlier intra-Court appeal has been filed in W.A.No.1804 of 2023, where notice had been ordered on 21.07.2023.

2. Today when the contempt petition is taken up for hearing, the learned Additional Advocate General appearing for the respondent has submitted that, since notice has been ordered in the writ appeal, this contempt proceedings has also got merged with the said proceedings, therefore, this contempt petition need not be kept pending anymore and it can be closed awaiting the orders to be passed in the writ appeal.

3. Though this submission made by the learned Additional Advocate General is opposed by Mr.P.Kumaravel, learned counsel appearing for the petitioner, considering these aspects, I am of the view that, this contempt petition, for the aforesaid reasons, can be closed for the present with a liberty to the petitioner to revive the same, depending upon the decision to be made by the Division Bench in the pending writ appeal. 2/4
