PRAYER in C.R.P.(PD)No.596 of 2022: The Civil Revision Petition is filed under Article 227 of the Constitution of India, pleased to direct the Hon'ble VI Additional Family Court at Chennai to dispose of H.M.O.P. No.3717 of 2018 on the file of the VI Additional Family Court at Chennai within a time frame manner.
For Petitioner in both C.R.Ps : Mr.M.I.Javid Akbar C O M M O N O R D E R These two revision petitions have been filed to expedite disposal of two matrimonial disputes in H.M.O.P. No.3727 of 2016 and H.M.O.P.No.3717 of 2018. H.M.O.P. No.3727 of 2016 has been filed by the revision petitioner for dissolution of marriage and H.M.O.P.No.3717 of 2018 has been filed by the respondent herein for restoration of conjugal rights. 2.The learned counsel for the revision petitioner submitted that the case is moving towards the final adjudication. The petitioner has given his side of the evidence and the respondent has also completed her evidence and it is posted for further evidence and that she has also filed some interlocutory applications to impede the progress of the trial.
3.This Court find merits in the submission.
4. The learned Judge, Family Court is required to expeditiously dispose of the matter within a period of four (4) months from the date of receipt of a copy of this order, excluding the summer recess, 2022. It is also underscored if any of the parties will file an Interlocutory Application as long as its consideration is not very germane for the trial of the matter, the learned Judge, Family Court has to separate the matter and enquire on the same day and also to proceed with the trial. This may be taken as general guidelines in the Family Court except perhaps the matter pertains to grant of interim alimony. 5.With the above direction, the above Civil Revision petitions are disposed of. No costs.
