Defendant Prayer : Civil Suit filed under Order XXXIV Rule 1 of CPC r/w Order IV Rule 1 and Order XXXVII, Rule 1 of Original Side Rules to pass a judgment and decree as against the defendants for the following reliefs:- a) directing the defendant to pay to the plaintiffs a sum of Rs.1,10,10,000/- (Rupees one Crore Ten Lakhs Ten Thousand only) (Principal sum of Rs.30,00,000/- together with the interest Rs.80,10,000/-) upto the date of this plaint and further together with the future interest at 36% on the said principal sum of Rs.30,00,000/- from the date of plaint till payment or actual realization; b) In default of payment on or before a date to be fixed by this Court, sale of the mortgaged property described in the Schedule hereunder and the sale proceeds be applied to the payment of the 1/4
money decree.
c) passing a personal decree against the defendants for balance amount which might remain unpaid even after applying the whole of the sale proceeds of the mortgaged property;
d) awarding cost of the suit to the plaintiffs; and e) passing such other relief or reliefs.

J U D G M E N T
The suit has been filed for recovery of money. 2.When the matter is taken up for hearing, a Joint Memorandum of Compromise was filed before this Court indicating that the parties have settled the dispute among themselves. The same has been acknowledged by the learned counsel appearing for both the parties.
3. In view of the Compromise that had been arrived at between the parties on the terms of Joint Memorandum of Compromise, the suit is disposed of as settled out of Court on the terms of Joint Memorandum of Compromise. 2/4
The said terms of Memorandum of Compromise is also annexed to this judgment.
