The Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the 2nd respondent to dispose the petitioner's representation dated 12.10.2010 and pass such further orders.

O R D E R

The Writ Petition has been filed seeking to direct the 2nd respondent to dispose the petitioner's representation dated 12.10.2010.

2. The learned counsel for the petitioner would submit that the petitioner made a representation on 12.10.2010 requesting the 2nd respondent to count half of the service paid from contingency along with the regular service for calculating retirement benefits. Since, no orders were passed by the 2nd respondent, the present writ petition is filed before this Court, for the aforesaid prayer.

3. When the matter came up for hearing, learned Additional Government Pleader placed a letter before this Court sent by the Chief Executive Officer/ 2nd respondent in Na.Ka. No.21679/E2(1)/2009 dated 23.01.2012 addressed to the https://hcservices.ecourts.gov.in/hcservices/

petitioner, stating that the request of the petitioner, to count half of the service paid from contingency along with the regular service while calculating retirement benefits, have been placed for consideration of the Board and that on approval of the Board Government order would be passed in this regard. Thereafter, no communication has been received by the Additional Government Pleader.

4. In the light of the above submission, if no orders have been passed till now, the respondents are directed to pass orders on the representation of the petitioner dated 12.10.2010, on merits and in accordance with law, as expeditiously as possible, preferably within a period of twelve weeks from the date of receipt of a copy of this order.

5. The Writ Petition is disposed of, with the above direction. No order as to costs.
