..Respondents/Defendants Application praying that this Hon'ble Court be pleased to delete the S.Nos.501/1A, 1B/1C/1D/3, 503/1/2, 504/1A, 503/1/2 in sengundram village, Chengalpet Taluk, Kancheepuram District in Item No.18 mentioned in the schedule to the plaint in C.S.No.252 of 2005. This application coming on this day before this Court for hearing the Court made the following order:- The prayer sought for herein is to delete the S.No.501/1A 1B/1C/1D/3 503/1/2 504/1A 503/1/2 in Sengundram Village, Chengalpet Taluk, Kancheepuram District in item No.18 mentioned in the schedule to the plaint in C.S.No.252 of 2005.
2. Heard the learned counsel for the applicant. When the case came up for hearing yesterday, i.e., on 20.03.2019, since no one was appearing for the respondents even though the respondents counsel names have been shown in the cause list, enabling the learned counsel for the respondents to appear before this Court, it is posted today.
3. Today also, when the case is called, no one is appearing for the respondent. In view of the above, having heard the learned counsel for the applicant and after
having gone through the affidavit filed in support of this application, this Court is inclined to pass the following order:
Since one of the property to the Schedule in the suit, they wanted to settle it otherwise therefore, the applicants wants to delete the particular property from the schedule to the suit, since the said prayer had been sought for by the applicants herein as there is no objection from the respondent side, as no one has chosen to appear before this Court, this Court is inclined to accept the prayer. Accordingly, this application is allowed.
The property in question which has to be deleted as per the prayer of the applicants can be deleted and accordingly, the applicants are permitted to carry out the amendment and file amended plaint copy within a period of two weeks.
