ORDER
The petitioner, who was arrested and remanded to judicial custody on 12.11.2025 seeks bail in S.C.No.15 of 2024 for the offence punishable under
Sections 294(b), 452, 302, 506(ii) of IPC in connection with Crime No.204 of 2023, registered on the file of the respondent.
2. Learned counsel for the petitioner submitted that the petitioner is an accused facing trial in S.C.No. 15 of 2024 on the file of the learned Xth Additional Sessions Judge, Chennai. He further submitted that since the petitioner was ill, he was unable to appear before the trial Court on 24.07.2025, and he was issued with the non-bailable warrant on 24.07.2025 and pursuant to the same, he was arrested on 12.11.2025. He further submitted that the petitioner is a sole breadwinner of his family and due to his incarceration, his family is suffering. He further submitted that the petitioner undertakes to cooperate with the trial. Therefore, he prays for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent submitted that since the petitioner, facing trial in S.C.No. 15 of 2024 on the file of the learned X Additional Sessions Judge, Chennai, has failed to appear before the trial Court, the trial Court has issued a NBW against the petitioner on 24.07.2025 and pursuant to the same, he was arrested on 12.11.2025. He further submitted that apart from this case, petitioner has three previous cases. Hence, he oppose for grant of bail to the petitioner.
4. Considering the facts and circumstances of the case and the bad antecedents of the petitioner and there is likelihood of stalling the trial if the petitioner is released on bail, this Court is not inclined to grant bail to the petitioner at this stage.
