ORDER
The petitioner, who was arrested and remanded to judicial custody on 27.12.2025 for the offences punishable under Sections 296(b), 103 of BNS, in Crime No.532 of 2025, registered on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that he is ranked as A2 in this case. It is alleged that there was a money dispute between the petitioner and the deceased, and that the deceased was unable to repay the money. Due to said dispute, the petitioner along with three other accused, allegedly abused the deceased. It is further alleged that A2 and A3 caught hold of the deceased, while A1 stabbed him on the neck and face, causing severe injuries. The deceased was thereafter admitted to the hospital and while he was taking treatment, he narrated the occurrence to his wife as well as his friends. Subsequently, the deceased succumbed to the injuries. Hence, a case has been registered against the petitioner and he was arrested.
3. The learned counsel appearing for the petitioner submitted that the petitioner has been arrested purely on suspicion and has been in judicial custody since 27.12.2025. He further submitted that no specific overt act has been attributed to the petitioner and that he is ready to co-operate with the investigation. Hence, he prays to grant bail to the petitioner.
4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that there are totally 4 accused in this case and the petitioner is ranked as A2. He further submitted that A1 in this case attacked the deceased, while the petitioner/A2 along with other accused caught hold of the deceased. He further submitted that the deceased made a dying 2/4
declaration to his family members and that two previous cases are pending against the petitioner. Hence, he opposed to grant bail to the petitioner.
4. Heard both sides and perused the materials available on record.
5. Considering the nature of the allegations, the overt act attributed against the petitioner and the motive behind the occurrence and that the petitioner has two previous cases, pending against him, this Court is not inclined to grant bail to the petitioner.
