This petition has been filed to modify the condition that the petitioner should produce a crossed Demand Draft for Rs.75,000/- drawn in favour of Chairman/District Collector, District Mineral and Foundation Trust of Kancheepuram District (Non Refundable) before the District Munsif cum Judicial Magistrate, Thirukalukundram imposed in the bail application Crl.M.P.No.583/2021 vide order dated 15.02.2021 passed by the learned Principal Sessions Judge of Kancheepuram District at Chengalpattu.

2. The case of the prosecution is that the petitioner/accused is a driver of lorry bearing registration No.TN-21-AX-7272 and he loaded 5 units white MSand without any valid permit.

3. Heard both sides.

4. The Court below, while granting bail to the petitioner directed that the petitioner shall produce a crossed Demand Draft for Rs.75,000/- drawn in favour of Chairman / District Collector, District Mineral and Foundation Trust https://www.mhc.tn.gov.in/judis/ 1/2

bri of kancheepuram District (Non Refundable) before the District Munsif cum Judicial Magistrate, Thirukalukundram. The said condition is sought to be modified by the present petition.

5. The learned counsel would submit that the petitioner is only a driver of the lorry, he had valid permit to transport M-Sand, he is very poor and not in a position to deposit Rs.75,000/-, hence sought for modification.

Considering the facts and circumstances of the case, the condition imposed in Crl.M.P.No.583 of 2021 dated 15.02.2021 by the Trial Court is modified to the effect that the petitioner shall produce crossed Demand Draft for Rs.25,000/- drawn in favour of Chairman/District Collector, District Mineral and Foundation Trust of Kancheepuram District (Non Refundable) before the District Munsif cum Judicial Magistrate, Thirukalukundram. All other conditions imposed in the said order remain intact. 26.02.2021 bri Note:- Issue order copy on 01.03.2021.
