ORDER

1. Mr.Sundareswaran, who appears for respondents 1 and 4, has reverted with instructions to the effect that the issue raised in the captioned writ petition is covered by the judgment of the Supreme Court in Idea Mobile Communication Limited V. Commissioner of Central Excise and Customs, Cochin, 2011 (23) S.T.R. 433 (SC) and the judgment dated 15.09.2016, passed in W.P.No.36562 of 2015, titled : M/s.S.R.P. Enterprises V. The Deputy Commercial Tax Officer.

2. Mr.S.Kanmani Annamalai, thus, states that since, the issue raised in the writ petition is covered against the Revenue by the aforementioned judgments, the impugned order would, obviously, have to be set aside.

2.1. Mr.V.Sundareswaran, who had appeared on the previous date, had contended likewise.

3. Accordingly, the impugned order is set aside.

4. The captioned writ petition is allowed, in the aforesaid terms. Resultantly, the pending application will stand closed. There shall, however, be no order as to costs. -s/dAssistant Registrar True Copy Sub-Assistant Registrar gg
