ORDER

The petitioner herein, who was arrested and remanded to judicial custody on 12.01.2026 for the offences punishable under Sections 111, 123 of BNS and Section 77 of Juvenile Justice Act, in Crime No.360 of 2025, registered on the file of the respondent police, seeks bail.

2.The allegation against the petitioner is that the petitioner is ranked as A7 in this case. It is alleged that A1 to A5 were arrested with 400 Tapentadol tablets. Subsequently, the police registered the FIR and conducted an investigation, which revealed that the arrested accused had procured the tablets from Delhi and sold them to various students for intoxication. Based on this, the petitioner was arrested along with 5390 tablets and he is in judicial custody. 3.The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case based on the confession statements of A1 to A5 and has been in judicial custody since 12.01.2026. It was further submitted that no contraband was seized from the petitioner and that is ready to abide by any condition that may be imposed by this Court and sought for bail to the petitioner.

4.The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the prosecution case and submitted that, apart from 1550 Tapentadol tablets recovered in this case, 210 Tramadol tablets were also seized. In addition, 5,000 Nicobliss Mouth-dissolving strips were recovered. He further submitted that the investigation in this case is pending and that the Tramadal tablets were also recovered, which fall under the NDPS Act. Hence, he opposed for the grant of bail to the petitioner.

5.Considering the huge quantity of various tablets, including contraband classified as a narcotic drug, recovered from the petitioner and the other arrested accused, and the investigation in this case is pending, hence this Court is not inclined to grant bail to the petitioner.
