ORDER

(Order of the Court was made by M.S.RAMESH.J,) This Writ Petition has been filed to call for the records pursuant to the impugned proceedings of the Central Administrative Tribunal, Chennai Bench order dated 02.01.2024 in O.A. No. 273 of 2018, and quash the same.

2. Heard the learned counsel for the petitioners and the learned

counsel for the respondents and have perused the documents.

3. When the respondents' pay fixation was reflected in the pay bill of 2017, as a consequential direction after quashing of the proceedings of the petitioners herein dated 07.06.2016, 16.09.2016 and 27.02.2017, the Central Administrative Tribunal through orders passed in O.S.No.310/00273/2018 dated 02.01.2024, had allowed the application. The order which is impugned in the present Writ Petition was on the basis of other order of the Banglore Bench of Central Administrative Tribunal in O.A.No.170/00252/2017 dated 23.07.2018.

4. When the order of the Banglore Bench dated 23.07.2018 was cited before the Tribunal, the petitioners herein did not dispute about the legal position and hence, the Tribunal had disposed of the application in terms of the decision of the Banglore Bench. As the petitioners herein had consented to pass such an order by the Tribunal, it is now not open to the petitioners to challenge the same.

5. We are unable to appreciate as to how the order of the Tribunal

could be found fault when the petitioners themselves have consented for passing of such an order. As such, there are no merits in the grounds raised in the Writ Petition and the same stands dismissed. No Costs. Consequently, connected miscellaneous petition is closed.
