ORDER

The petitioner's daughter Ms.K.r.Manjari is doing III year Engineering (EEE) Course in the 3 rd respondent's College. After Pongal holidays, she returned to the College on 23.01.2017, however, she did not report to the College on 23.01.2017 and reported only on 24.01.2017. Since the petitioner's daughter failed in a few subjects, the petitioner's family advised her to study well and complete the degree in time. In view of that, she was disturbed. Therefore, it seems, she stayed with her cousin Mr.Mahi on the day without informing the petitioner and thereafter she reported to the College only on 24.01.2017. Due to the above incident, the 3 rd respondent College is not permitting the petitioner's daughter to continue her studies. Therefore, the petitioner sent a representation to the 2 nd respondent on 20.02.2017 and to the 4 th respondent on 21.02.2017.

Inspite of that, the respondents 3 and 4 are not permitting the petitioner's daughter to continue her studies. Further, the 1 st respondent has issued a communicated dated 23.02.2017 addressed to the 4 th respondent informing the College that they should not

prevent the students from attending the classes without getting sanction from the Anna University. Even after the communication dated 23.02.2017, the 3 rd and 4 th respondents are not permitting the petitioner's daughter to attend the classes, which compelled the petitioner to approach this Court.

2. Heard Mr.R.Prabudoss, learned counsel for the petitioner, Mr.L.P.Shanmugasundaram, learned Special Government Pleader, appearing for the 1 st and 2 nd respondents and Mr.B.Rabu Manohar, learned counsel appearing for the 3 rd and 4 th respondents.

Mr.B.Rabu Manohar, learned counsel appearing for the 3 and 4 th respondents would submit that the Institution has got no objection in allowing the petitioner's daughter to continue her studies as a day scholar and there is no possibility of accommodating her in the hostel. The learned counsel for the petitioner also agreed for the same.

4. The 3 rd and 4 th respondent seem to have taken a decision in the interest of the Institution to accommodate the petitioner's daughter only as a day scholar and moreover, it is the discretion of the rd and 4 th respondents in this regard. Therefore, this Court is not

inclined to interfere with the same.

5. Taking into consideration the overall situation, it is appropriate for the petitioner's daughter to be accommodated in the rd and 4 th respondents College as a day scholar, which the 3 respondent has also agreed.

6. The learned counsel for the 3 rd and 4 th respondents would submit that the student can report to the College tomorrow itself viz., 15.03.2017 as a day scholar.

The petitioner's daughter Ms.K.R.Manjari, is directed to report to the 3 rd and 4 th respondents College on 15.03.3017 at 09.00 a.m. and the respondents 3 and 4 are directed to allow the petitioner's daughter to continue her course. With the above direction, the writ petition is disposed of. No costs.
