Respondent in both the petitions /2nd Defendant COMMON PRAYER: Civil Revision Petitions filed under Article 227 of the Constitution of India against the fair and decreetal orders dated 11.06.2012 made in I.A.Nos.939 & 940 of 2011 in O.S.No.380 of 2005 passed by the learned Second Additional District Munsif, Court at Coimbatore. For Petitioner : Mr.J.Franklin C O M M O N O R D E R This Civil Revision Petitions have been filed as against the orders of the trial Court in allowing the applications filed by the respondent/defendant to reopen the evidence and recall himself who has been examined as DW1 to adduce further evidences. The trial Court has allowed the applications subject to the payment of Rs.750/- by the petitioner to the respondent. 2.It is seen that the trial Court has exercised its discretion in order to give an opportunity to the party to produce certain documents. When the trial Court has exercised its discretion and allowed the party to produce documents, it cannot be interfered mechanically.

3.Hence, this Court is of the view that mere filing of such documents by the defendant will not cause any prejudice to the https://hcservices.ecourts.gov.in/hcservices/

plaintiff. Moreover, the plaintiff is at liberty to confront those documents in the cross examination.

4.In the result, these Civil Revision Petitions are dismissed. No costs. Consequently, connected miscellanous petition is closed. The trial Court is directed to dispose of the suit within three months from the date of receipt of the copy of this order.
