The Original Petition filed under Sections 218 and 278 of the Indian Succession Act, 1925, seeking Letters of Administration without Will relating to the estate of N.Chandrasekar, the brother of the petitioner, who died intestate on 05.09.2021.

2. The details relating to the immovable properties and also the bank account have been given in Schedule 'A' and Schedule 'B' to the petition.

3. After following due procedure, the petitioners were directed to tender evidence.

4. Accordingly, the 1st petitioner examined himself as P.W.1. The Death Certificate of his mother Mrs.Sarojini and Legal Heirship Certificate were marked as Exs.P1 and P2. The Death Certificate and the Legal Heirship Certificate of C.Vasantha, wife of N.Chandrasekar were marked as Exs.P3 and P4. The Death Certificate of N.Chandrasekar was marked as Ex.P5.

5. It is specifically stated that no children were born to N.Chandrasekar.

6. Ex.P6 is the order rejecting the Legal Heirship Certificate since the petitioners are class-II legal heirs. The details relating to the properties were marked as Exs.P7 - P20 and P24.

7. In view of the evidence presented, the Original Petition stands allowed. Letters of Administration is granted to the petitioners. The petitioners shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) in the name of the Assistant Registrar (Original Side), High Court of Madras.
