It is submitted by the learned Additional Public Prosecutor that the FIR in Crime No.1512 of 2009 on the file of the respondent was enquired into and final report was filed before the Judicial Magistrate on 2.9.2010 as civil in nature.

2. It is submitted by the learned counsel for the petitioner that the petitioner was not called for enquiry and refer charge sheet was not served on the petitioner.

3. Considering the submission of the learned Public Prosecutor that the case has been referred as civil in nature and final report was also filed on 2.9.2010, the petition is dismissed.
