O R D E R
This Criminal Original Petition has been filed to transfer the investigation in Crime No.107 of 2019, on the file of the third respondent to the first respondent or some other investigation agency for further investigation. Heard Mr.P.Kumaresan, learned counsel appearing for the petitioner and Mr.V.Balamurugan, learned Additional Public Prosecutor, appearing for the respondents and perused the materials placed on record.
The learned Additional Public Prosecutor has filed a status report and submitted that on the complaint lodged by the petitioner, FIR has been registered in Crime No.107 of https://hcservices.ecourts.gov.in/hcservices/
2019 for the offences under Section 174 of Cr.P.C and Section 201 of IPC.
Thereafter, they have dropped further investigation in Crime No.107 of 2019, on 30.01.2020 and filed a final report before the Jurisdiction Court on the same day i.e., 30.01.2020.
Considering the above facts and circumstances, at this stage, transfer of investigation does not arise. Therefore, this Court is not inclined to transfer the investigation in Crime No.107 of 2019. However, the third respondent is directed to serve the referred charge sheet and notice to the petitioner within a period of two weeks from the date of receipt of a copy of this order. On the receipt of the same, the petitioner is at liberty to file protest petition before the concerned Jurisdictional Court. With the above direction, this Criminal Original Petition stands disposed of.
