This Court, after dismissal of the writ petition in W.P.No.33860 of 2017, heard this Writ Miscellaneous Petition for modification of the order, filed along with an affidavit with distorted facts. The prayer in the Writ Miscellaneous Petition was on the basis of a letter of Sub-Registrar addressed to this Court, as if the order of this Court requires clarification and the clarification should be done on his letter. 2.Though this Court is of the view that the Sub-Registrar should be hauled for contempt (both criminal and civil), taking a lenient view, accepted the unconditional apology tendered by the Sub-Registrar. However, the conduct of the Sub-Registrar, by name Mr.R.Rajendran, shall be taken note of by the Inspector General of Registration, Tamil Nadu, who may get an explanation from the concerned individual, if required, to secure smooth and better administration in the Registration Department.
3.Learned counsel appearing for the petitioner has admitted that it is a mistake on the part of the petitioner in approaching this Court for clarification on the basis of a letter of the Sub-Registrar and he also tendered his apology for approaching this Court without properly reading the papers and understanding the nature of documents sought to be registered. Having regard to the fact that this Court had already imposed a cost of Rs.10,000/- while dismissing the Writ Miscellaneous Petition, this Court is not inclined to pass any further orders. Thus, the matter stands closed.
