Prayer: Criminal Original Petition filed under Section under Section 528 of BNSS, 2023 praying to modify the condition that "(i) the petitioner shall produce the document worth of Rs.17,00,000/- (Rupees Seventeen Lakh Only) wither by accused or any one surety." imposed on the petitioner in Crl.M.P.No. 2285 of 2025 by the learned Principal Sessions Judge, Puducherry dated 25.06.2025.

ORDER
This Criminal Original Petition is filed seeking for modification of the condition imposed in Crl.M.P.No.2285 of 2025 vide order dated 25.11.2025 by the learned Principal Sessions Judge, Puducherry, wherein, the relevant Paragraph No.6(i) of the above order which reads as follows:- 1/4
"6(i). the petitioner shall produce the document worth of Rs.17,00,000/- (Rupees Seventeen Lakh Only) wither by accused or any one surety." imposed on the petitioner in Crl.M.P.No. 2285 of 2025 by the learned Principal Sessions Judge, Puducherry dated 25.06.2025.

It is stated that the learned Principal Sessions Court directed the petitioner to deposit a document pertaining to the property is not legally sustainable, which is also onerous condition, and the petitioner has not agreed or given any undertaking to deposit the documents. 3.I have also gone through the order passed in Crl.M.P.No.2285 of 2025 vide order dated 25.11.2025 by the learned Principal Sessions Judge, Puducherry, it reveals that the trial Court granted bail to the petitioner with certain conditions imposed on him. Further, the deposit of document is a major reason for deciding the bail in favour of the petitioner herein, and now, the petitioner seeks modification of the same. Though in the order, there is no mention about the consent of the petitioner was obtained or not, undoubtedly, without the consent if any order is being passed directing the petitioner to deposit the property document, is a onerous condition. 2/4
4. In view of the same, this Court set aside the order passed in Crl.M.P.No.2285 of 2025 vide order dated 25.11.2025 by the learned Principal Sessions Judge, Puducherry. However, considering the fact that the offence is serious in nature, this matter is remitted back to the trial Court is with direction to re-consider the bail order granted to the petitioner on merits in the manner known to law.
5.With the above directions, this Criminal Original Petition is disposed of.
