BY [ RESPONDENT ] THE INSPECTOR OF POLICE, VIGILANCE AND ANTI CORRUPTION, SALEM.

(CR.NO.08/AC/2006).

Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) To relax the condition of the present condition is that the petitioner to report and to sign on first working day of every English Calendar month at 10.30 am before the learned Special Judge, (Special Court for Trial of Cases under the prevention of Corruption Act), Salem on 12.07.2019 in Spl.C.C.No.64 of 2014, the condition imposed by this Hon'ble court Crl.M.P.No.11106/2019 in C.A.No.501 of 2019 dated 08.08.2019.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.T.PANCHATSARAM, Advocate for the petitioner, and of M/S.V. SARATHA DEVI, Govt. Advocate ( Crl. Side) on behalf of the Respondent, the court made the following order:- The above petition is filed seeking to relax the condition imposed by this Court on the petitioner/Appellant/accused vide order dated 8.8.2019 in Crl.MP.No.11106 of 2019 in Crl.A.No.501 of 2019.

2. This Court, by order dated 08.08.2019, had suspended the sentence imposed on the petitioner with a direction to report before the Trial Court at 10.30 a.m., on the first Monday of every English Calendar Month, pending appeal.

3. The learned counsel for the petitioner would submit that the petitioner ws complying the condition from 04.09.2019 till today and due to his working condition, he would seek relaxation of the condition of appearing before the Trial Court on the first working day of every month.

4. Heard the learned Government Advocate (Crl.Side), on the submissions made by the learned counsel for the petitioner and he reported that the petitioner has been complying with the order imposed by this Court.

5.Taking into consideration the submissions made by the learned counsel on either side, the condition imposed by order dated 08.08.2019 is hereby modified. The petitioner shall appear before the trial Court on the first working day of March at 10.30 a.m. and thereafter once in six months on the first working day of the concerned month at 10.30 a.m., pending disposal, until further orders.

6.The petition is ordered accordingly.
