ORDER
This writ petition has been filed seeking a direction to the first respondent to consider the petitioner's representation dated 15.07.2025 and reminder dated 10.01.2026.
2. The case of the petitioner is that the fourth respondent, who is an employee of TASMAC, had lodged a complaint against the petitioner under Section 138 of N.I.Act in STC No.343 of 2018 before the Special Criminal Court, Salem. The said complaint was dismissed on 29.04.2021, inter alia, raising questions as to how the said Kumar, being a Government employee of TASMAC, was permitted to engage in a money-lending business and how he could prosecute a complaint by appearing before the Court on regular intervals
without obtaining prior written permission from department. The petitioner has also sought action against the fourth respondent in that regard. The acts of commission and omission allegedly committed by the fourth respondent amount to misconduct attracting disciplinary action. An enquiry was conducted before the third respondent, in which both the petitioner and the fourth respondent participated. On 23.12.2021, the third respondent, addressed a communication to the second respondent. Thereafter, the petitioner sent representation dated 15.07.2025 and reminder dated 10.01.2026. However, no action has been taken against the fourth respondent. Hence, the present writ petition has been filed.
3. Heard the learned counsel appearing on either side.

Considering the facts and circumstances of the case, without going into the merits of the case, the first respondent is directed to consider the petitioner's representation dated 15.07.2025 and dispose of the same within a period of eight(8) weeks from the date of receipt of a copy of this Order, on merits and in accordance with law, after affording an opportunity of personal hearing to the petitioner as well as the fourth respondent to put forth his case.
5. The order has been passed without issuing notice to the fourth respondent, as the matter is being disposed of at the stage of admission. It is made clear that the competent authority shall hear the fourth respondent before taking a decision.
