Mr.A.N.Thambidurai, Special Govt.Pleader Prayer : Writ Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus directing the respondent to regularise the services of the petitioner in the post of Village Assistant from 04.10.2010 based on her representation dated 14.07.2010 along with all consequential benefits. .
O R D E R
The petitioner was appointed as Village Assistant of Pillaiyarpalayam village, Ulundurpet Taluk on 04.10.2010. She was issued with a show cause notice dated 27.10.2010, informing that the petitioner is not eligible for the said post as she was over qualified. Thereafter, similarly placed persons as that of the petitioner had filed writ petitions before this Court, wherein, this Court had held that over qualification is not a disqualification and the show cause notices were quashed. However, the writ petition filed by the petitioner was dismissed for default and the petition to restore the writ petition was also dismissed. Thereafter, the petitioner came to know that the order passed by this Honourable Court in the batch of Writ petitions will enure the benefit to the petitioner also. Hence, the petitioner submitted a detailed representation to the respondent on 14.07.2017, which did not evoke any response. 2. Mr.A.N.Thambidurai, learned Special Government Pleader takes notice on behalf of the respondents and submits that the representation of the petitioner has already been considered and the services of the petitioner has been regularised with effect from 11.10.2010.
3. Accordingly, recording the said statement of the learned Special Government Pleader, the writ petition is closed. No costs. Consequently, connected miscellaneous petition is closed.
