(The case has been heard through video conference) The petitioner is a sole accused. He was arrested and remanded to judicial custody on 01.12.2020 for the offence punishable under Section 363, 376 AB of I.P.C. 5(m), 5(l), 6 of POCSO Act, 2012 in Crime No.1183 of 2020 on the file of respondent police and now, he has filed this petition for anticipatory bail.

2. The case of the prosecution is that the accused is a neighbour of defacto complainant. The petitioner is aged 55 years old and the victim girl is 6 years old. He said to have sexually assaulted the victim girl. Based on the complaint given by her parents, a criminal case was registered against the petitioner and he was arrested and remanded to judicial custody on 01.12.2020. 3. I have heard and considered the rival submissions made by the learned counsel appearing for petitioner as well as learned Additional Public Prosecutor appearing for respondent.

4. On perusal of statement of victim girl, a minor, aged about 6 years old, he has sexually assaulted and also acted in a cruel manner with a minor girl. Therefore, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
