ORDER

The petitioner, who was arrested and remanded to judicial custody on 12.12.2025, for the offences punishable under Sections 304(2) of BNS in Crime No.752 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that on 06.12.2025, evening, when the defacto complainant was proceeding in a two wheeler namely Yamaha Fascino bearing Registration No.TN-15-M-3783 along with her minor son at Sirvangur to Vaniyanthal Road, the petitioner along with two others wrongfully restrained her by using criminal force and intimidation, forcibly snatched her 4 1⁄2 sovereigns of gold chain. Hence, the case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 12.12.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that the petitioner along with two others have committed robbery of 4 1⁄2 sovereigns of gold jewellery belonging to the defacto complainant. Though the stolen property is recovered, it is not ground for granting bail. He further submitted that the investigation in this case is pending and there are two previous cases pending against the petitioner. Hence prays for dismissal of the petition.

5. I have heard the submissions made on both sides and also perused the materials available on record.

On considering the facts and circumstances of the case and the submissions made by both counsel and also on considering the gravity of offence committed by the petitioner, and the fact that there are 2 previous cases pending against him, and investigation is at the initial stage and also the fact that there is possibility of tampering the witnesses and hampering the investigation, this Court is not inclined to grant bail to the petitioner.
