The civil revision petition is filed against the order dated 28.11.2023 in IA No.701 of 2019 in OS No.204/2017 on the file of the Sub Court, Palacode.
2. The petitioner is the plaintiff and the respondent 1 to 14 are defendants in OS No.204 of 2017 on the file of the Sub Court, Palacode. In the said suit, the petitioner/plaintiff has filed IA.No.701 of 2019 in OS No.204/2017 seeking to implead respondents 15 to 21 as proposed defendants, and the same is pending till date. Hence, the petitioner has filed the present civil revision petition.
3. Learned counsel for the petitioner submits that the impleading application is pending from the year 2019 without out progress. Hence, seeking to allow the Revision.
4. Heard the learned counsel for the petitioner and perused the
materials available on record.
5. Further, pursuant to the direction of this Court, the Registry, on verification through e-filing, has reported that the total pendency of the Sub Court, Palacode, is 714 cases.
6. Considering the nature of the proceedings and also taking note of the fact that the case is pending from the year 2019 without any progress, the learned Sub Court, Palacode, is directed to dispose of IA No.701 of 2019 in OS No.204 of 2017, within a period of three months from the date of receipt of a copy of this order.
7. With the above direction, the Civil Revision Petition is allowed. There shall be no order as to costs.
