The petitioner, who was arrested and remanded to judicial custody on 25.08.2023 for the alleged offence under Sections 307 @ 302 of IPC in Crime No.599 of 2023 on the file of the respondent police, seeks bail. 1/4

2.This is the second bail application filed by the petitioner. Though the earlier bail petition of the petitioner was dismissed on 28.11.2024 in Crl.O.P.No.29612 of 2024 by my learned predecessor, Hon'ble Justice T.V.Thamilselvi, this petition is listed before this Court pursuant to the orders passed by the Hon'ble Division Bench of this Court in Crl.O.P.No.31787 of 2024 on 04.03.2025.

3. The case of the prosecution is that the petitioner has caused the death of three persons including her son. Hence, the case.

4. The learned counsel appearing for the petitioner submitted that this is the 3rd bail application filed by the petitioner; that the petitioner was suffering from mental illness and she requires treatment and that further custody is likely to worsen her situation. Hence, he prayed for grant of bail to the petitioner.

5. The learned public prosecutor submitted that the petitioner was given treatment at Special Prison for Women. He also produced the report of the Medical Officer. The learned Public Prosecutor further submitted that the trial is 2/4

pending in S.C.No.323 of 2023 on the file of the III Additional District and Sessions Judge, Poonamallee.

6. The allegations against the petitioner are grave in nature. She has caused the death of three persons including her son. There is no change in circumstances warranting grant of bail at this stage. Hence, this Court is not inclined to grant bail to the petitioner. However, the petitioner cannot be detained indefinitely during bail. Hence, the trial Court may conclude the trial as expeditiously as possible. If the trial is not concluded within 6 months, the petitioner shall be at liberty to renew the bail application before the trial Court.

7. Accordingly, this Criminal Original Petition is dismissed. 17.03.2025 Sma 3/4
