.. Respondent This application has been filed by the judgment debtor to condone the delay of 54 days in filing the appeal as against the order dated 06.12.2024 passed by the learned Master in E.A.No.5115 of 2023 in E.P.No.51 of 2023.

2. A counter affidavit has been filed in this application. According to the respondent, no sufficient cause has been shown by the applicant for condoning the delay. On the other hand, in the affidavit filed in 1/3

support of this application, the applicant has stated that due to their preoccupation they were unable to meet their counsel for the purpose of filing an appeal.

3. Without going into the merits of the contention of the respective counsels, this Court, considering that the delay is 54 days, is inclined to allow this application, without prejudice to the rights and contention of the respondent in the main application. Accordingly, this application is allowed as prayed for, without prejudice to the rights and contention of the respondent in the main application to be filed by the applicant aggrieved by the order passed by the learned Master in E.A.No.5115 of 2023 in E.P.No.51 of 2023, dated 06.12.2024. Registry is directed to number the application, if it is otherwise in order, and list the same for hearing on 02.04.2025.
