Application No.819 of 2024 ABDUL QUDDHOSE,J.

The suit has been filed for recovery of money for the alleged non-payment of the value of the goods supplied by the plaintiff to the defendant.

The plaintiff claims that as per the contract, all the disputes are subject to Chennai jurisdiction only. The plaintiff also claims that part of cause of action arose within the jurisdiction of this Court, since part-payments are made by the defendant to the plaintiff only at Chennai and statement of accounts were exchanged between the plaintiff and the defendant only at Chennai.

Since part of cause of action has arisen within the jurisdiction of this Court, this Court is inclined to grant leave to sue as prayed for. Accordingly, leave to sue is granted and the application is allowed as prayed for.

Registry is directed to number the suit, if it is otherwise in order.
