Respondents PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus directing the respondents No.1 to 4 to consider and dispose of petitioner's representation dated 15.02.2022 and 16.02.2022 respectively with regard to the Tender publication dt.13.01.2022 issued by the 3rd respondent with regard to considering petitioner's bid.

O R D E R

This Writ Petition is premature. The petitioner states that he had made attempts to participate in the tender floated on 13.01.2022 for construction of tribal girls hostel at Peenjamandhai in Jawadhu Hills in Vellore District. 2.He would state that he was entitled to such participation as the tender was itself entrusted to the contractors belonging to Adi-Dravidar or Tribals. However, when he approached the office of the 4th respondent to submit the bid along with the requisite documents and Demand Draft, he had been prevented from submitting the tender and restrained by rowdy elements. 3.Be that as it may, he says that he lodged a complaint before the District Collector on 15.02.2022 and no action has been taken till date.

4.It is seen that the date of complaint is itself very proximate to the filing of the Writ Petition and it is for the petitioner to allow the respondents sufficient time to process the same in a manner known to law, without waiting for which, he has rushed to the Court.

5.Hence, this Writ Petition is dismissed as premature. It is made clear the express statement of learned Counsel for the petitioner to the effect that the tender process has not been challenged is recorded. No costs. Consequently, connected miscellaneous petition is closed.
