Heard the learned counsel for the petitioner and the learned counsel appearing on behalf of the respondents and perused the records.

2. The petitioner by the present writ petition has assailed the action of the second respondent in issuing the impugned charge memo dated 30.12.2020 and proceeding further on the basis of the aforesaid charge memo.

3. When the matter is taken up for hearing, the learned counsel for the respondents submit that pursuant to the aforesaid charge memo issued, the respondent authorities had appointed an enquiry officer, who had conducted enquiry and submitted a report; and that based on the said report, further action is to be taken.

Since, it is now stated into this Court that the petitioner having submitted to the jurisdiction of the enquiry officer and having submitted explanation, which has been considered by the enquiry officer who is stated to have submitted a report and is pending consideration for passing final orders by the second respondent, this Court is of the view that the cause in the writ petition does not survive for consideration, as it is now stated that the respondent authorities would be taking further action based on the enquiry report. It is made clear that in the event of the respondents passing any adverse order against the petitioner, the petitioner is at liberty to avail further remedies open to him in accordance with law.
