COMMON PRAYER: Writ Petition filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus, directing the respondents 1 and 2 to recover the amount as per the certificate issued on 31.12.2020 & 03.03.2020 respectively, by the Deputy Commissioner of Labour, Salem as on date and to remit the same as per the certificate apart from any other
damages for the sufferings caused to the petitioner by negligent act of the 3rd respondent.

COMMON ORDER The Petitioners are employed as Senior Tradesman under the third respondent Corporation and retired from service. The grievance of the petitioners is that the third respondent has not settled the gratuity amount till date and they also approached the Deputy Commissioner of Labour, who is acting as the Controlling Authority. The Controlling Authority has also passed an order in the P.G.Case No.111 of 2018 on 07.02.2019 directing the third respondent to pay a sum of Rs.7,04,804/- along with interest @ 10% per annum from 01.06.2014 to till date. Even though, the third respondent has not settled the full amount to the petitioners. Aggrieved over the same, the petitioners are before this Court.
2. The learned counsel appearing for the third respondent would submit that they are ready to settle the money, within a period of two weeks.
3. Recording the statement of the learned counsel for the third respondent, a direction is issued to the respondents 1 and 2 to recover the amount from the third respondent and settle the same to the petitioners, within a period of two weeks from the date of receipt of the copy of this order.
4. Accordingly, the writ petitions are disposed of. No costs.
