Writ Petition has been filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus to direct the respondents to consider the petitioner's representation dated 06.10.2016 forwarded to the 2nd respondent by the 1st respondent for appointment of the petitioner as Grade II Constable For Petitioner : Mr.Dr.G.Krishnamurthy For Respondents : Mr.R.A.S.Senthilvel, Additional Government Pleader.

By consent, the writ petition is taken up for final disposal.

2. The petitioner has applied for the post of Grade II Police Constable and according to him, though he was selected, he was not given any employment. The petitioner, in this regard, approached this Court by filing a writ petition in W.P.No.12806/2015 praying for issuance of writ of Mandamus directing the respondent to consider the representation dated 05.07.2016 forwarded to the 1st respondent by the 2nd respondent and to appoint him as Grade II Police Constable. The said writ petition was dismissed on 28.04.2015 abserving that employment cannot be given to the petitioner based on the community certificate issued by the Tahsildar, Thiruvallur District. https://hcservices.ecourts.gov.in/hcservices/

Dr.G.Krishnamurthy, learned counsel appearing for the petitioner would submit that the community certificate has been issued by the Zonal Deputy Tahsildar, Tiruvannamalai District, stating that the petitioner belongs to Reddy Ganjam community which is recognized as a Backward Class community and as such, there cannot be any impediment for considering his request for appointing him to the post of Grade-II Police Constable in the available vacancies and prays for appropriate orders.

4. This Court, heard the submission of Mr.R.A.S.Senthilvel, learned Additional Government Pleader, who accepts notice on behalf of the respondents.

5. This Court, taking into consideration the limited scope of the prayer sought for by the petitioner and also without going into the merits of the claim projected by the petitioner, directs the 2nd respondent to consider and dispose of the petitioner's representation dated 06.10.2016 on merits and in accordance with law and pass orders within a period of six weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioner.
