Respondent(s) PRAYER:-Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Mandamus, directing the respondents 2 and 3 to survey and demarcate with boundaries of the petitioners lands in S.No.632/2 (New S.No.632/2B) to an extent of 39.5 cents, situated at Kukuttamarudhahalli Village, Pennagaram Taluk, Dharmapuri District with assistance 4th respondent Police based on her application dated 01.01.2026. ORDER
This writ petition has been filed seeking for a direction to the respondents 2 and 3 to survey and demarcate the property, which according to the petitioner is owned by her, based on her application dated 01.01.2026, within a time frame to be fixed by this Court.
2.The petitioner had submitted an application on 01.01.2026 for the aforesaid purpose. Since the same has not been considered till date, the petitioner has filed this writ petition.
3.Mr.C.Jayaprakash, learned Government Advocate accepts notice on behalf of the respondents 1 to 3. Mr.Venkatatesa Perumal, learned Government Advocate (Crl.Side) accepts notice on behalf of the fourth respondent. 4.Since no adverse orders are passed against the private respondents, notice to the respondents 5 to 8 is dispensed with in this writ petition by this Court.
5.No prejudice will be caused to the respondents 2 and 3 if the said authorities are directed to survey and demarcate the boundaries of the petitioner's property, more fully described in the prayer to this writ petition, after hearing the objections if any from the neighbouring land owners as well as any other party as they deem fit. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the lands in question, the respondents 2 and 3 are directed to issue notice to the
neighbouring land owners and also to any other party, if they deem fit to put on notice.
(b) After receiving objections if any and after considering the same, the respondents 2 and 3 shall conduct survey and demarcate the boundaries of the property, more fully descried in the prayer to this writ petition, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.
(c) If the need arises for police assistance and on a request made by the third respondent, the fourth respondent shall render police assistance for the effective implementation of this order.
