The present petition has been filed to modify the condition imposed on the petitioner in Paragraph No.5 of the order dated 27.01.2021 passed by this Court in Crl.MP.No.509 of 2022 in Crl.OP.No.23298 of 2021 while granting bail.

The learned Counsel for the petitioner has submitted that this Court while modifying one of the bail conditions in Crl.MP.No.509 of 2022 in Crl.OP.No.23298 of 2021 directed the petitioner to deposit a sum of Rs.5,00,000/- in cash to the credit of Crime No.495 of 2018 and to deposit the title deed of the property belongs to her husband for the remaining amount of Rs.30,00,000/- to the credit of Crime No.495 of 2018 along with encumbrance certificate before the concerned Court and further directed the petitioner and her husband to file an affidavit before the concerned Court that they will not create any encumbrance over the property nor they claim title deeds until the disputes are resolved. He submits that the petitioner is 1/4
having some difficulty in depositing title deeds which stands in the name of her husband. He further submits that instead of furnishing the documents in respect of the property standing in the name of her husband viz., Manickam, she is ready and willing to give the property in Ponneri admeasuring around 4 grounds which stands in the name of the petitioner's aunty viz., Mrs.Palayathammal worth more than Rs.35,00,000/- as security. On instructions, the learned counsel for the petitioner submits that the petitioner will transfer the said title deed in her name and later the same will be furnished by her .
3. Heard the learned counsel Government Advocate (Crl.Side) appearing for the respondent. He submits that he has no objection to modify the condition.

Considering the facts and circumstances of the case and the submissions made by both counsel, this petition is allowed by modifying the condition to the effect that the petitioner shall deposit a sum of Rs.5,00,000/- (Rupees Five Lakhs only) in cash to the credit of Crime No.495 of 2018 and the petitioner shall deposit her title deed of said property situated at Ponneri 2/4
along with encumbrance certificate, undertaking affidavit before the concerned Court within a period of four weeks from the date on which, the order copy was made ready.
5. Except the above modification, the other conditions imposed by the Court in Crl.MP.No.509 of 2022 in Crl.OP.No.23298 of 2021 vide order dated 27.01.2022, shall remain unaltered.
6. With the above modification, these Criminal Original Petitions are allowed.
