Mr.A.Mohammed Gouse COMMON ORDER These two applications have been filed to condone the delay of 1406 days in filing the petition to restore the Second Appeal and to restore the Second Appeal.
2. In the affidavit filed in support of the petitions, it had been contended that the first petitioner herein is the owner of the suit property C.V.KARTHIKEYAN,J., 1/2 https://www.mhc.tn.gov.in/judis
CMP Nos.14175 & 14176 of 2025 vum consequent to the Settlement deed executed in the year 1999 by her parents / first and second appellants. It had also been stated that her father who is the first appellant herein had died on 31.03.2016. He was only looking after the second appeal which was dismissed for default on 18.04.2016. The petitioner claimed that she was not aware of the nature of the case pending before the Court and hence in filing the application to restore, there has been a delay.
3. Heard the learned counsel for the respondents also.
4. Taking all these factors into consideration, both the applications stand allowed. The delay is condoned. The Second Appeal is restored on file.
