DATED : 16.04.2021

CORAM

THE HON'BLE MR. JUSTICE G.K.ILANTHIRAIYAN and CMP.No.7077 of 2018 1.Sampathu 2.Nageswaran .. Petitioners Vs.

Nagappan ..Respondent Prayer: Civil Revision Petition filed under Article 227 of Constitution of India, to set aside the fair and decreetal order dated 28.07.2017 made in I.A.No.29 of 2017 in O.S.No.227 of 2012 on the file of the District Munsif, Arni.

For Petitioner : Mr.M.T.Arunan

ORDER

This Civil Revision Petition has been filed against the fair and decreetal order dated 28.07.2017 made in I.A.No.29 of 2017 in O.S.No.227 of 2012 on the file of the District Munsif, Arni.

2. The Civil Revision Petition was posted for admission on 11.04.2018 and at the request of the learned counsel for the petitioner, 1/4

the matter was adjourned to 16.04.2018. Again on 16.04.2018, at the request of the learned counsel for the petitioner, it was adjourned to 12.06.2018 and also at the request of the learned counsel for the petitioner, it was adjourned to 19.06.2018. On 19.06.2018, this Court directed the Trial Court to proceed with the matter in accordance with law, without waiting for the orders to be passed in the present Civil Revision Petition. Even then, the learned counsel for the petitioner failed to argue the case and at his request, the matter was adjourned. It clearly shows that the learned counsel for the petitioner has no interest in proceeding with the case further. Mere pendency of the Civil Revision Petition would not serve any purpose.

3. Therefore, this Court is not inclined to entertain this petition. Accordingly, the Civil Revision Petition is dismissed. No costs. Consequently connected miscellaneous petition is closed. 16.04.2021 Speaking/Non-speaking order Index : Yes/No Internet : Yes/No lpp 2/4
