Crl.MP.No.2486 of 2023 in Crl.OP.No.24362 of 2022 SATHI KUMAR SUKUMARA KURUP.J., This Criminal Miscellaneous Petition has been filed to amend the bail satisfaction as the learned Judicial Magistrate No.III, Salem instead of the learned "Principal Sessions Judge, Salem".
2.The learned Counsel for the Petitioner submitted that this Court while granting Anticipatory Bail in Crl.O.P.No.24362/2022 imposed a condition to the Petitioner to deposit Rs.50,000/- to the Court of the learned Principal District Judge, Salem. Subsequently, the Petitioner filed a Petition in CMP.No.15847/2022 seeking to reduce the amount of Rs.50,000/- stating the financial difficulties in the Petitioner's family. Considering the financial difficulties of the Petitioner's family, this Court reduced the amount as Rs.10,000/- by order dated 03.11.2022.
3. It is the further submission of the learned Counsel for the Petitioner that the FIR is pending on the file of the learned Judicial Magistrate - III, Salem. Therefore, the condition stipulated by this Court to deposit the amount 1/3
has to be amended in such a manner, instead the learned Principal District Judge, Salem, it should be the learned "Judicial Magistrate - III, Salem".
4. The learned Government Advocate (Crl. Side), on instructions of the Investigation Officer, submitted that the FIR is pending on the file of the learned Judicial Magistrate - II, Salem under whose jurisdiction the Suramangalam Police Station in this case is attached to. Therefore, the Petitioner shall be directed to deposit the amount of Rs.10,000/- to the Court of the learned Judicial Magistrate - II, Salem instead of the learned Judicial Magistrate No.III, Salem.
5.The learned Counsel for the Petitioner sought one month time to deposit the amount.
In the result, this Criminal Miscellaneous Petition is allowed. The Petitioner is directed to deposit the amount of Rs.10,000/- (Rupees Ten Thousand only) before the Court of the learned Judicial Magistrate - II, Salem within a period of one month from the date of receipt of a copy of this order.
