ORDER

The petitioner, who was arrested and remanded to judicial custody on 12.12.2025, for the offences punishable under Sections 309(4) of BNS in Crime No.567 of 2025, registered on the file of the respondent police, seeks bail.

2. The case of the prosecution as per the defacto complainant is that the accused joined together and by threatening her at knife point, robbed 63 grams of gold chain from her. Hence the case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 12.12.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that there are totally eight accused involved in this case and the petitioner is arrayed as A2; that the petitioner is having 3 previous cases; that the stolen property is recovered from the accused; and that the investigation of this case is still pending.

5. I have heard the submissions made on both sides and also perused the materials available on record.

On considering the facts and circumstances of the case and the submissions made by both counsel and also on considering the gravity of offence committed by the petitioner, and the fact that there are 3 previous cases pending against him, and investigation is at the initial stage and also the fact that there is possibility of hampering the investigation, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
