ORDER

The Petitioner has filed this Transfer Civil Miscellaneous Petition seeking to withdraw H.M.O.P.No.170 of 2024 pending on the file of the Subordinate Court, Tirupattur and transfer the same to the Family Court, Krishnagiri to be tried along with O.S.No.18 of 2024.

2.O.S.No.18 of 2024 has been filed by the respondent against the petitioner herein seeking maintenance before the Family Court, Krishnagiri.

3.Heard the learned counsel for the petitioner and perused the materials available on record. Though notice has been served on the respondent, she has not entered appearance either in person or through counsel.

4. The petitioner is only seeking to transfer the H.M.O.P to the Family Court, Krishnagiri where the respondent herself has filed a case and the same is pending. He would submit that it is difficult to contest the cases at two places. Therefore, no prejudice would be caused to the respondent, if H.M.O.P.No.170 of 2024 is withdrawn and transferred to the file of the Family Court, Krishnagiri.

5. Accordingly, this Transfer Civil Miscellaneous Petition is allowed and H.M.O.P.No.170 of 2024 pending on the file of the Subordinate Court, Tirupattur is withdrawn and transferred to the file of the Family Court, Krishnagiri to be tried along with O.S.No.18 of 2024. No Costs.
