ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Section 302 of IPC, in Crime No.374 of 2014, seeks anticipatory bail. 2.
This Criminal Original Petition for Anticipatory Bail has been filed under Section 438 of Cr.P.C. In fact, the case of the petitioner is that for his non appearance, the Trial Court has issued Non Bailable Warrant and the same is pending since, 16.11.2021. The petitioner has to resort relief under Section 70(2) of Cr.P.C before the Trial Court which has issued Non Bailable Warrant. 3.Hence,the petition filed under Section 438 of Cr.P.C is not maintainable. Accordingly, this Criminal Original Petition is dismissed.
