Respondents [R5 is suo moto impleaded Vide Order of the Court dated 04.03.2021 in W.P.No.4921 of 2021] Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the fourth respondent herein for issuance of the patta in petitioner's name with regard to the property of the land comprised in Survey No.108/1, Town Survey No.17/1, measuring an extent of 18 ares situated in Thiruthooraipoondi Village, Thiruthooraipoondi Taluk, Tiruvarur District in the light of the recommendations of the Special Tahsildar (Land and Tax) in his letter dated 29.06.2016 by the consideration of the representation made by the petitioner on 26.01.2021 for issuance of patta.

ORDER

The petitioner has approached the Tahsildar, Thiruthooraipoondi Taluk, Thiruvarur District, the fourth respondent herein for issuance of patta vis-a-vis Natham settlement.

2. Mr.E.Balamurugan, learned Special Government Pleader enters appearance for respondents 1 to 4 and made a statement on instructions that the Tahsildar is now required to hold a preliminary enquiry, and that it is scheduled to take place at 11.00 a.m., on 13.05.2021 in the office of the fourth respondent/Tahsildar and once the enquiry is over, a report will be forwarded to the District Revenue Officer, Tiruvarur, who is not a party herein, who would pass the final order for the same.

3. This Court directs impleadment of the District Revenue Officer, Tiruvarur, suo moto as the fifth respondent, and Mr.E.Balamurugan, learned Special Government Pleader takes notice for him.

4. In view of the above, no direction is required to be given except that the fourth respondent/Tahsildar, Thiruthooraipoondi Taluk, Thiruvarur District, is directed to hold an enquiry after issuing notices to all the parties who are likely to be affected by his decision, and after providing the parties a fair and effective hearing within a period of twelve

(12) weeks (from the conclusion of the General Election of the Tamil Nadu State Legislative Assembly- 2021) from 13.05.2021, wherein after, the report of the Tahsildar with necessary records may be forwarded to the District Revenue Officer, Tiruvarur, who would hold an enquiry and dispose of the matter within a period of 12 (twelve) weeks thereafter.
