Respondent(s) PRAYER:-Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Mandamus, directing the Respondents 2 to 4 to effect sub-division and issuance of patta in the name of the petitioner with regard to his property in S.No.244 / 1A, to an extent of 57 1⁄2 Cents, bearing the Patta No.135, situated at Avadathur Village, Mettur Taluk, Salem District as per the sale deed dated 04/06/1969 in Doc.No.1063 /1969.

ORDER

This writ petition has been filed seeking to direct the respondents 2 to 4, to effect sub-division and thereafter issue patta in the name of the petitioner for the property more fully disclosed in the prayer to this writ petition. 2.The petitioner has filed the supporting documents along with his application seeking to effect sub-division and issuance of patta in his name for the property more fully disclosed in the prayer to this writ petition. Since the said application was not considered by the respondents, the petitioner has filed this writ petition.

3.Mr.S.Arumugam, learned Government Advocate accepts notice on behalf of the respondents.

4.No prejudice will be caused to the respondents if the petitioner's application dated 08.05.2023 seeking for sub-division and issuance of patta in his name for the property more fully disclosed in the prayer to this writ petition is considered on merits and in accordance with law, by giving due consideration

to the supporting documents filed by the petitioner, after hearing the objections of the neighbouring land owners, if any as well as any other third party whom the 4th respondent deems it fit to enquire, within a time frame to be fixed by this Court.

5.This Court is not expressing any opinion on the merits of the petitioner's application dated 08.05.2023.

6.For the foregoing reason, this writ petition is disposed of by directing the 4th respondent to pass final orders on merits and in accordance with law on the petitioner's application dated 08.05.2023, seeking to effect sub-division and issuance of patta in his name for the property more fully disclosed in the prayer to this writ petition, by giving due consideration to the supporting documents filed by the petitioner, after hearing the objections of the neighbouring land owners, if any as well as any other third party, whom the 4th respondent deems it fit to enquire, within a period of twelve (12) weeks from the date of receipt of a copy of this order. No costs.
