Prayer: This Criminal Revision case filed under Section 397 read with Section 401 of Code of Criminal Procedure to set aside the order of acquittal dated 13.06.2012 in C.C.No.36 of 2010 on the file of Additional District Munsif-cum-Judicial Magistrate Court, Ambur.

ORDER

The defacto complainant has preferred the Criminal Revision against the order of acquittal passed by the learned Additional District Munsif-cum-Judicial Magistrate Court, Ambur in C.C.No.36 of 2010.

2. The petitioner/defacto complainant preferred a complaint against the respondent 2 and 3 for offence punishable under Section 447 and 506(ii). The learned trial Judge, after full fledged trial, acquitted the accused by a well reasoned order. As against the same, the petitioner has come forward with this petition.

3. As against the judgment of acquittal appeal lies before the Sessions Court as per amended Act. Therefore, this Revision does not lie before this Court, accordingly it is dismissed. However, if the petitioner wants to file an appeal before the Sessions Court, he can file. The period spent for this revision is exempted for the purpose of limitation.
