This writ petition has been filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, order or direction in the nature of a Writ, directing the respondents to calling upon the petitioner for certificate verification for the post of Nurse as per Notification No.01/15, dated 19.04.0215 issued by the first respondent. O R D E R

This petition has been filed for direction to the respondents to calling upon the petitioner for certificate verification for the post of Nurse as per Notification No.01/15, dated 19.04.0215 issued by the first respondent.

2. The petitioner is a B.SC Nursing degree holder and he belongs to B.C. community. He appeared in the competitive examination held on 28.06.2015, conducted by the first respondent and secured 59.50 marks out of 100 marks. The petitioner came to understand that the first respondent called upon the candidates for certificate verification, even who secured lessor marks than the petitioner. The first respondent announced that the cut off marks for appointment of nurse post is 47% and the candidates who secured more than 47% are eligible for certificate verification. petitioner secured 59.50%, he was not called for certificate verification. Hence, this writ petition.

3. The learned Additional Government Pleader submitted subsequent to the filing of the writ petition, the petitioner was selected and appointed as nurse in the 2nd respondent Department.

4. The above said submission of the Additional Government Pleader is recorded. In the light of the above said submission, the prayer sought for in this writ petition cannot be granted, since the petitioner has already got appointment. Therefore, the petition is liable to be dismissed.

5. In the result, the writ petition is dismissed. No costs.
