Apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 341, 302 and read with 34 of IPC in S.C.No.386 of 2013 and on the file of the respondent police, the petitioners have come forward with this petition seeking anticipatory bail.
2. The learned counsel for the petitioners submitted that as the petitioners have not appeared before the trial court, the learned I Additional Sessions Court, Chennai, issued Non Bailable Warrant against the petitioners and hence, they have come forward with the present petition for anticipatory bail.
3. The learned Government Advocate [Criminal Side] that the petitioner shall be directed to appear before the trial court and file a petition section 70(2) Cr.P.C.
4. As NBW is pending and that the petitioner submits that his father is suffering from cancer; that he is the only son to attend to his father at Adyar cancer hospital and that the father died later due to which the petitioner could not appear on the hearing dates, the petitioners are directed to appear before the trial court and file necessary application and it shall be considered by the learned Magistrate in accordance with law. This Petition is disposed of accordingly.
