O R D E R

The petitioner, who was apprehending arrest at the hands of the respondent police for the offences punishable under Sections 103(1) of BNS, 2023 in Crime No.688 of 2025, seeks bail.

2. The allegation against the petitioner is that he is a friend of A1, who is running a shop where the deceased had pledged certain gold jewels. It is stated that A1 suspected the genuineness of the pledged jewels and, along with another person, suspected the deceased and the persons accompanying her, demanding repayment of the pledged amount. As the deceased was unable to return the money, A1, A2, A3 and other persons present in the market allegedly joined together and assaulted her using a wooden log, reaper wood and PVC pipe, and continued the attack from noon till about 8.00 p.m. Unable to bear the attack, the deceased succumbed to the injuries. Hence, a case has been registered against the petitioner and he was arrested.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that a co-accused has already been granted bail by this Court in Crl.O.P.No.2511 of 2026, dated 09.02.2026. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.side) reiterated the prosecution case and submitted that there are totally 6 accused in this case and the petitioner is ranked as A3. He further submitted that all the accused jointly attacked the victim lady from 1.30 p.m. to 8.00 P.M. using various weapons and that this petitioner specifically assaulted her with a PVC pipe. Hence, he opposed to grant bail to the petitioner.

5. Heard the learned counsels on either side and perused the materials available on record.

6. Considering the specific overt act attributed to the petitioner, namely, that he attacked the victim with a PVC pipe, which is stated to have resulted in her death, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 10.02.2026 kmm
