The Civil Revision Petition is filed seeking a direction to the learned District Munsif cum Judicial Magistrate, Thiruporur, Kancheepuram 1/4
District, to dispose of O.S.No.232 of 2023 as expeditiously as possible by fixing a time limit.
2. The petitioner herein filed a suit seeking declaration that the sale deed dated 06.07.2007 executed by the defendants 6 to 11 in favour of defendants 1 to 5 was null and void and for consequential injunction.
3. The suit was originally filed before the District Munsif Court, Chengalpattu, on 10.11.2008 and numbered as O.S.No.358 of 2008. It is stated by the petitioner that the first defendant filed a written statement on 23.07.2009 and the defendants 7 to 11 filed a written statement on 26.03.2010. At this juncture, the suit was transferred to the file of the District Munsif cum Judicial Magistrate, Thiruporur, Kancheepuram District and renumbered as O.S.No.232 of 2023.
4. It is seen from the affidavit filed by the petitioner dated 13.11.2025, the issues have not been framed in the suit till date and three interlocutory applications are pending. The details of the same read as follows:
I.A.No.1 of 2021 : Petition to bring the LR's of 6th defendant 2/4
I.A.No.2 of 2025 : Petition to bring the LR's of defendants 7 and 9 I.A.No.3 of 2025 :Petition to implead the proposed 3rd plaintiff-pendente -lite purchaser
5. Since the applications to bring on record the Legal representatives of 6, 7 and 9 and also the application to implead the proposed 3rd plaintiff pendente lite purchaser are pending, this Court is not inclined to issue direction to dispose of the main suit. However, taking into consideration, the suit was of the year 2008, the trial Court is directed to dispose of the pending interlocutory applications as expeditiously as possible. After disposal of the interlocutory applications, the trial Court shall give priority to the suit and dispose of on its own merits, as the same is more than 15 years old. Accordingly, the Civil Revision Petition is disposed of. No costs.
