Consequent to the death of the first defendant, Mrs.Ragini Rajkumar, the plaintiff has filed these applications to condone the delay of 541 days in filing the application to set aside the abatement; to set aside the abatement; and to bring the legal heirs of the first defendant on record as the 3rd and 4th defendants in the above suit.
2. On instructions, learned counsel appearing for all the defendants, including the proposed defendants, submits that he has no objection to these applications being allowed.
3. Upon examining the affidavit in support of these applications and being satisfied that sufficient cause is shown, these applications are allowed as prayed for. As a corollary, the plaintiff is permitted to carry out the amendments in the plaint on or before 14.03.2023 and serve a copy of the amended plaint on the defendants within a week thereafter.
4. The interim order issued earlier is extended until the next date of hearing. List on 21.03.2023.
