ORDER
The petitioner herein participated in the recruitment process in response to the notification dated 07.03.2012 for filling up the post of Teachers for Classes I to V and VI to VIII. In terms of the said notification, the last date for submission of application was 04.04.2012. The qualification that is required to be possessed by the candidates who intends to participate in the recruitment process is Higher Secondary Course (10+2 Patterns) and Diploma in Teacher Education from a recognized Teacher Training Institute / DIET. The candidates who have appeared in D.T.Ed./B.Ed., during the relevant academic year are also eligible to appear for the Teacher Eligibility Test under the above said notification.

Though the petitioner was successful in the written examination, the claim of the petitioner for appointment was rejected during the course of certificate verification on the ground that the petitioner failed to produce the certificate evidencing that she possessed the qualification of D.T.Ed. Aggrieved by the same, the petitioner approached this Court by filing the present writ petition.

From the affidavit filed in support of the writ petition, it is noticed that the petitioner has appeared for the final examination of D.T.Ed only in the month of June 2012 and the results of the same were published in the month of December 2012. Whereas the notification in question was issued on 07.03.2012 and the last date for submission of application under the said notification was 04.04.2012. Neither on the date of notification nor on the last date for submission of application for the appointment to the post of Teacher for Classes I to V and VI to VIII, the petitioner had not possessed the qualification of D.T.Ed nor she has appeared for final examination of the said course.

In the circumstances, the petitioner cannot be said to possess Page No.3 of 6
eligibility criteria as required under para 3 of the notification dated 07.03.2012. In the light of the above, this Court does not find any error or illegality in the action of the respondents in not considering the case of the petitioner for appointment to the post of Teacher for Classes I to V and VI to VIII.

Accordingly, the writ petition is dismissed and the connected miscellaneous petitions, if any shall stand closed. No costs. 07.08.2024 (1⁄2) Index :
